On September 15, 2026, Business Wire reported that First Solar intended to voluntarily withdraw its Section 337 complaint and seek termination of the investigation pending before the U.S. International Trade Commission without prejudice to refiling later.
The company said it would continue pursuing existing TOPCon patent lawsuits in U.S. District Court, including cases against affiliates of Canadian Solar, Jinko Solar, T1 Energy and Trina Solar. First Solar also said it intended to resume efforts to enforce its global TOPCon patent portfolio against other manufacturers it believes infringe those patents.
First Solar said the strategy change followed the U.S. administration’s Section 232 action concerning imports of polysilicon and its derivatives. The company obtained its U.S. TOPCon patents and related international patents through its 2013 acquisition of TetraSun, Inc.
