International Container Terminal Services, Inc. is defending its partnership with South Africa's Transnet for the development of Durban's Pier 2 terminal after a legal challenge by Maersk. FreshPlaza reported on November 4, 2026, that the dispute is before the KwaZulu-Natal High Court and has already delayed the terminal upgrade.

Legal challenge keeps project in focus

The court previously issued an interdict after Maersk filed its challenge. ICTSI was named the preferred bidder in April 2023 and says it remains ready to begin work while supporting improvements in operational efficiency, transparency and reliability.

ICTSI argues that it met and exceeded the procurement requirements. The company said its bid totaled R12 billion and received a perfect evaluation score, while Maersk bid R9.2 billion and received a score of 83 percent, according to the FreshPlaza report.

Transnet confirmed that the case remains before the KwaZulu-Natal Division of the High Court in Durban. Transnet and APM Terminals have made initial submissions, while ICTSI is expected to present its case next. The court process leaves the timing of the planned development uncertain.

Independent model shapes positioning

ICTSI describes itself as one of the world's largest independent terminal operators, developing and managing gateway terminals across six continents, according to its company profile. Its business is focused on port development, terminal management and container handling in origin and destination markets.

In the Durban contest, ICTSI is positioned against Maersk and APM Terminals, both named in the court proceedings. ICTSI stresses that it does not combine terminal operations with a shipping line, unlike Maersk, which the company presents as a basis for serving shipping lines independently.
