Two emergency motions have now been filed with the Federal Constitutional Court in Karlsruhe. Greens health policy spokesperson Janosch Dahmen and Ates Gürpinar of the Left Party are seeking a judicial halt to Friday's planned vote, arguing that their parliamentary rights as legislators have been violated. Dahmen recalled that the same court blocked a vote on the 2023 heating law after a similar emergency petition.

Beyond the procedural standoff, the underlying financial projections for the statutory health insurance (GKV) are stark. The savings package is designed to cut billions in costs from 2027 onward by capping reimbursement increases, raising co-payments, and limiting free spousal insurance. But the gap is already widening: the GKV faces a shortfall of nearly €19 billion in 2027, with the deficit potentially climbing to €40 billion by 2030. Green MP Felix Banaszak warned that up to 140,000 jobs in German hospitals are at risk if the system is not stabilised.

Resistance is also building in the Bundesrat, the chamber representing Germany's 16 states. Mecklenburg-Western Pomerania's state premier, Manuela Schwesig, has already announced she will vote against shortening the legislative timeline. Even if the bill clears the Bundestag on Friday, approval from the upper house is far from assured. Both the Alternative for Germany (AfD) and the Left Party have also said they will petition the constitutional court.
