Workers with a disability rating of 50 or higher are entitled to a package of workplace protections that many never fully use, according to revised legal guidelines published in July. The new documents clarify everything from extra holiday time to tax breaks, but experts warn that most employees fail to claim what they are owed.

The Core Protections for Severely Disabled Workers

Anyone classified as severely disabled — defined as having a Grad der Behinderung (GdB) of at least 50 — gains access to several statutory benefits. These include five additional paid vacation days per year, the right to refuse overtime, and a claim to workplace assistance known as Arbeitsassistenz.

Perhaps the most significant safeguard is the enhanced dismissal protection. Employers cannot terminate a severely disabled worker without first obtaining approval from the Integrationsamt, the state integration office. This requirement applies regardless of company size or length of service.

The guidelines also detail funding options designed to keep disabled people in work. Among them are the Budget für Arbeit (a wage subsidy for employers), special training allowances, and grants aimed at job retention. Chronic illnesses, the documents note, can qualify as disabilities if they meet the severity threshold. The overall GdB is calculated from individual impairment values, but these are not simply added together — a formula determines the final rating.

Crucially, employees have no legal obligation to disclose their disability to their employer unless it directly affects their ability to perform the job.

How Workers With Lower Ratings Can Still Gain Protection

Employees whose GdB falls between 30 and 40 are not automatically classified as severely disabled, but they can apply for Gleichstellung — legal equal status. This is granted if they would otherwise struggle to find or keep a suitable job. Once approved, they receive the same enhanced dismissal protection as those with a GdB of 50 or higher.

The process for obtaining a GdB rating begins with an application to the local Versorgungsamt (pension office). Challenging an unfavourable decision can pay off: statistics from Baden-WĂĽrttemberg for 2024 show that 25 percent of appeals resulted in a more favourable outcome for the applicant. The deadline to file an objection is four weeks, though the reasoning can be submitted later. If the appeal is rejected, a free claim can be filed at the Sozialgericht (social court), where no lawyer is required.

Tax Breaks and Financial Perks Rise With Disability Severity

The financial advantages are directly tied to the GdB level. For the 2026 tax year, the following allowances apply:

  • GdB 20: The lowest tier. The tax-free disability allowance is €384 per year. No workplace benefits or equal-status rights are available at this level.
  • GdB 70: The annual allowance rises to €1,780. If the person holds the Merkzeichen G (severely disabled with reduced mobility), they can also claim a travel-cost deduction of up to €900.
  • GdB 100: The top tier offers a €2,840 annual allowance. For those with additional markers such as H (helplessness), Bl (blindness), or TBl (deaf-blindness), this jumps to €7,400. Travel-cost deductions can reach €4,500, and a full exemption from vehicle tax is possible.

Other benefits at GdB 100 include a €1,800 housing-benefit tax-free allowance and the option of early retirement after 35 contribution years — two years before the standard retirement age without deductions, or up to five years early with penalties.

What the Disability Card Does Not Guarantee

The guidelines stress that holding a Schwerbehindertenausweis (severely disabled ID card) does not automatically unlock other social benefits. For example, claiming care allowance (Pflegegeld) requires a Pflegegrad 2 (care level 2), assessed by the Medizinischer Dienst (medical review board). The GdB alone is insufficient.

In the private sector, there is no legal right to waived bank account fees; each bank decides individually. Companies like Amazon offer discounted memberships (€4.49 instead of €8.99), but only to those who already qualify for a broadcasting-fee exemption or hold a social pass — not solely on the basis of a disability rating.

A landmark ruling by the Bundesverwaltungsgericht (Federal Administrative Court) in November 2025 (case reference 3 C 17.23) reinforced the need for individual assessments in professional licensing. The court held that a visual impairment cannot automatically disqualify someone from obtaining a medical licence. Each case must be examined individually to determine whether the applicant can safely practise in their chosen speciality.
