Beyond the clinical and financial challenges, BioNTech faces ongoing litigation from Arbutus Biopharma and Genevant Sciences, who have filed patent infringement claims regarding lipid nanoparticle technology used in Comirnaty. Cases are pending before both a Canadian federal court and the Unified Patent Court. BioNTech has vowed to defend itself vigorously, but the proceedings could drag on for years, creating a persistent overhang.
