While investors approved three of four proposed resolutions, they refused to sign off on consulting contracts put forward by management. On top of that, two supervisory board candidates reserved the right to decline their elections to the oversight body. That combination knocked out a central precondition for the restructuring plan, leaving the previous rescue framework largely obsolete.

Management has said it is reviewing further steps, but the company's own warning is blunt: absent a viable understanding with lenders, insolvency looms. That extension, however, offers the executive board nothing more than a short pause. A sustainable outlook can only emerge if the lenders agree to a comprehensive reorganization of the debt burden — and the failed conditions at the shareholder meeting make those talks considerably harder.

October Vote Becomes the Next Flashpoint

The next decisive moment arrives within days. A further creditor vote is scheduled for October 17 to 19, 2026, with a broad restructuring on the agenda — including a possible extension of the bond's maturity out to 2030. In a separate development, the company's capital structure shifted after the issuance of subscription shares: the total number of voting rights climbed to 83,593,723 on Thursday.

Whether a bankruptcy filing can be averted will ultimately be settled at the negotiating table with creditors, where Branicks must now move quickly to reach an understanding with its key lender groups. Should that accommodation fail to materialize in the coming days, the real estate group faces the prospect of payment default.
